Terms of Use
1. Introduction
- The software “Vote for the return of the Parthenon Sculptures” is the electronic interactive voting (hereinafter “electronic voting”) created by the stock corporation “Athens International Airport S.A.” (AIA), having its registered seat in Spata, Attica, 19019.
- AIA reserves the right to modify, supplement or alter the content or the electronic voting, as well as the terms of use, whenever it deems so necessary and without prior notice, by means of a simple announcement via electronic voting. Users are requested to check the content of the Terms for any changes.
- The nullity of any Terms hereof shall not entail the nullity of the remaining terms. The non-exercising by AIA of its rights under these terms shall not entail AIA's waiver of such rights. AIA shall not be liable for any breach of these terms due to reasons of force majeure, including, without limitation, extreme weather events, earthquakes, floods, fires, emergencies, etc.
2. Intellectual property rights
- The entire content of the electronic voting, including (but not limited to) pictures, graphics, photographs, designs, texts, illustrations, the services and products provided, is the intellectual property of AIA and is governed by the relative national and international provisions on intellectual property. Any infringement thereof shall compel the offender to restore in full any actual or consequential damages of AIA.
- Any use, copying, distribution, transfer, transformation, storage, loading (download), resale, creation of derivative work or misleading the public about the actual provider of the content is expressly prohibited. Any reproduction, republication, uploading, posting, distribution or transmission or any other use of the Content in any way or by any means, for commercial or other purposes, shall be permitted only with the prior written authorisation of AIA.
- Any names, pictures, logos, trademarks and distinctive features that are contained in the electronic voting are the property of AIA and/or the persons that are referred to as owners of the relevant rights in the electronic voting and are protected in accordance with the operative legislation on industrial and intellectual property. Their appearance should in no way be construed as a transfer or assignment of license or right to use the same. Any third-party intellectual property works included in the electronic voting have been placed in good faith and for information purposes. It is obvious that they will be removed upon request by the beneficiaries.
3. Disclaimer
- AIA makes every effort so that all the Content and information displayed on electronic voting are characterized by accuracy, clarity, correctness, completeness, timeliness and availability. But in no case does AIA guarantee and, consequently, cannot be held liable (not even by negligence) for any damage caused to the user from its use.
- The content and services are provided “as is”, without warranty of any kind, either explicit or implied, expressed or presumed, including the warranties of satisfactory quality, suitability, inviolability, compatibility, safety and accuracy, which are all expressly denied. Moreover, AIA is not responsible for restoring any damages (actual or consequential, which may, by way of example, consist in loss of profits, data, lost future gains, money restitution, etc.) suffered by users/visitors of the electronic voting, or by third parties, due to reasons related to the operation or not, the use thereof, any failure to provide information / services that are provided by the content, or by any unauthorized third-party interventions in services/ information that are made available through it. AIA use its best efforts to ensure the proper operation of the electronic voting; however, in no case AIA warrants that the operation of the electronic voting or the servers will be uninterrupted or without fault of any kind, free of viruses and similar items, whether it is the electronic voting, or any other site or server through which its content is transmitted.
4. User's Liability
Users accept, agree and stipulate that:
- They shall make use of the electronic voting according to the law, moral conventions and the application terms of use.
- There is no possibility of canceling their votes.
- Shall not proceed to actions or omissions that can cause damage to AIA, to the content and operation of the electronic voting or to intellectual property rights of third parties.
5. Protection of Personal Data
AIA complies with the applicable legislation for the protection of data subjects with regard to the processing of their personal data. The corporate framework for personal data management and protection is presented in the respective Privacy Notice
